CCSO Data Analytics Platform: Terms & Conditions
Critical Care Services Ontario (CCSO) is a provincial agency funded by the Ministry of Health, with a mandate to identify critical care system needs and, through collaboration with health care partners, lead the development and implementation of programs to improve access, quality, integration and value for patients while adhering to specific principles of leadership, collaboration, transparency, innovation, patient centeredness, results focus, and improvement through knowledge translation. The program areas that CCSO fulfills this mandate for include adult critical care, paediatric critical care, neonatal intensive care, trauma and burns, neurosurgery, and the provincial Life or Limb policy. The CCSO Data Analytics Platform, hereafter referred to as the “Platform”, enables access to interactive dashboards with key indicators and business intelligence features that are customizable for hospitals and system leaders to deliver on CCSO’s mandate.
Please read the following terms and conditions of use carefully before using this Platform. If you do not agree to these Terms of Use, you must not register or access the Platform. To protect the privacy rights of patients, the interests of patients and participating hospitals with legislative requirements under the Personal Health Information Protection Act, 2004 (PHIPA) and other applicable Provincial legislation, each individual Authorized User/Agent (referred to as “I” and “me” in what follows) must accept and comply with the following:
1. Using CCSO's Data Analytics Platform
1.1.The Platform and these Terms of Conditions are subject to the laws in the Province of Ontario.
1.2.I will abide by the privacy and security policies, procedures and practices of the Organization in which I am employed and in which is indicated by the user in the Platform registration process (hereafter referred to as the “Organization”), applicable legislation (including but not limited to PHIPA), and applicable professional standards and guidelines.
1.3. To the extent permitted by PHIPA, I will only use information accessed through the Platform for the purposes of:
1.3.1. Monitoring performance to improve access, quality, and integration of critical care services.
1.3.2. For the purpose of activities to improve or maintain the quality of care or maintain the quality of any related program or services for my Organization.
1.4. This platform is intended for critical care system decision making and planning. No part of this platform is to be shared for public distribution.
1.5. I will keep my computer access codes secure and will not share them with others and will ensure that I promptly log out of the Platform at the end of each session. I will not attempt to, or circumvent, or facilitate the circumvention of the security features of the Platform.
1.6. If I print out or copy any information, I will ensure that such information is maintained in a secure manner and in accordance with the privacy policies of my Organization, or is disposed of in a secure manner.
1.7. I acknowledge and understand that my access rights to the Platform are based on my role in my Organization. I will not transfer or assign my access rights to the Platform to any other individual. I will notify CCSO immediately upon transferring my position or leaving the Organization via info@ccso.ca.
1.8. If I become aware of any security or privacy breaches involving information available on the Platform, privacy or security policies, or procedures and practices implemented by CCSO, I will immediately notify CCSO via info@ccso.ca as well as the privacy contact at my Organization. I understand that CCSO or the most appropriate agency may launch a breach investigation and that the investigation may include the sharing of my personal information. I agree to cooperate with CCSO in any breach investigation that may be launched.
1.9. I acknowledge that audits of access to and the use of information made under my user access account through the Platform will be completed and that my personal information may be used or disclosed for the purpose of carrying out and acting upon the results of such audit.
1.10. When using the Platform, information will be transmitted over a medium that may be beyond the control and jurisdiction of CCSO. As such, CCSO assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the Platform.
2. Confidentiality
2.1. I understand that I am hereby granted a limited, non-exclusive right by CCSO to use the information in the Platform for those specific purposes reasonably contemplated by these Terms and Conditions. I further agree that I will not otherwise use the Platform in any manner except to the extent permitted within these Terms and Conditions.
2.2. I agree that the information in the Platform shall be treated as confidential, not be disclosed to any third party or to my staff except on a “need to know” basis, and not be used for any purpose other than that contemplated within these Terms and Conditions.
2.3. In the event a that any Personal Health Information (PHI) is inadvertently disclosed, I shall immediately notify CCSO upon discovery via info@ccso.ca so that CCSO can immediately remove such PHI. For clarity, it is acknowledged and agreed that the Platform is designed not permit the disclosure or collection of any PHI.
3. User Privacy Policy
3.1. Summarized below is the information CCSO collects about you during your Platform visit:
3.1.1. Cookies – Like most websites, the Platform uses small pieces of information called “cookies” that are stored on the hard drive of your computer. Cookies let us “remember” information about your preferences and allow you to move within areas of our site fast and easily. These cookies contain anonymous, non-personal information.
3.1.2. Information about your visit – In order to improve access to our Platform and determine what information visitors access most frequently, CCSO may track statistics such as IP address, browser type, domain name, access times and referring website addresses.
3.1.3. Third-party sites – This Platform may contain links to external websites. CCSO is not responsible for the privacy practices or the content of any third-party website.
3.1.4. CCSO will not distribute any personal information gathered through the site, nor will CCSO sell it to any third party. However, CCSO reserves the right to disclose personal information if disclosure is pursuant to legal proceedings.
4. General Information
4.1. I understand that CCSO’s failure to act with respect to a breach by a user or others of these Terms and Conditions of Use does not waive its right to act with respect to subsequent or similar breaches. These Terms and Conditions of Use set forth the entire understanding and agreement between CCSO and any user with respect to the Platform, its uses and services.
4.2. These Terms and Conditions constitute the entire agreement between you and CCSO with respect to the use of the Platform.
4.3. CCSO may revise and update these Terms and Conditions without notice at any time. Your continued usage of the Platform will be deemed an acceptance of those changes. The most current version will always be posted to the Platform’s registration page.
4.4. I acknowledge that I have read, have had an opportunity to seek clarification of, and understand the above obligations. By accepting these Terms and Conditions, I hereby acknowledge and agree that any unauthorized collection, access, use, disclosure, storage and disposal of confidential, personal or personal health information are serious breaches. If I do not agree to all of these Terms and Conditions of use, I will not use this Platform. Breach of this agreement may result in disciplinary action that may include the disabling of the user’s account for the Platform, being reported to any regulated health professional college of which the user is a member, being reported to Ontario’s Information and Privacy Commissioner (IPC), and may be subject to legal action, fines, or penalties.
